만화진흥법 제정안에 관한 소고

Abstract

만화는 원소스 멀티유스 시대의 원천 콘텐츠로서 그 중요성이 매우 크지만, 한국의 만화산업은 정부의 지원 부족과 무관심으로 인해 열악한 환경 속에 방치되어 있다. 이에 만화가들이 중심이 되어 만화진흥법 입법을 추진하고 있는바, 이 법은 만화진흥위원회라는 별도의 진흥기구를 설립하고 만화발전기금이라는 별도의 기금을 조성하여 한국만화발전을 도모하는 것이 주요 내용이다. 그러나, 이 법은 한국콘텐츠진흥원이라는 통합된 문화콘텐츠 진흥기구와 부천의 한국만화영상진흥원이라는 유사 기구가 존재하는 현 상황에서 입법에 난항이 예상되고, 만화의 정의 규정과 별도의 만화저작권보호위원회 설치 등의 입법 내용에 대해서는 신중한 재검토가 요망된다. 그럼에도 불구하고, 한국문화콘텐츠산업의 발전을 위해서 본 법의 입법 필요성과 당위성은 충분히 인정되므로 조속한 법 제정이 이루어지도록 국회와 소관 부처의 적극적인 관심이 요망된다.

Even though the cartoon is very crucial as a source content in the one-source multi-use era, the Korean cartoon industry is still in the poor condition due to the government's indifference and lack of support. Hence, many cartoonists are now trying to enact a special law to promote the cartoon industry, which sets forth the establishment of the Cartoon Promotion Committee and the Cartoon Development Fund. However, it would raise a big controversy in that there exist similar agencies such as the Korea Creative Content Agency (KOCCA) and the Korea Manhwa Contents Agency (KOMACON) in Bucheon. The draft bill also needs more fine-tuning with regard to the definition of the cartoon and the establishment of the Cartoon Copyright Protection Commission. Nevertheless, the legislation of the Cartoon Promotion Act is necessary and urgent for the purpose of the growth of the Korean culture industy and the Congress and the government should get interest to pass the bill.
