A Study on Measures to Improve Legislative System to Implement Policy Measures for Enhancing the Rights and Interests of Youth
I. Background and Purpose of Research
○ The current administration, which took office on May 10, 2022, has also made it one of its top national priorities to offer hope to youth by encouraging them to pursue their dreams.
○ The formulation of a master plan under Article 8 of the Framework Act on Youth led to the first and the second implementation plans in 2021 and 2022, respectively.
○ Despite such master plan and implementation plans for youth policy, it is necessary to examine measures for improving legislative system to ensure that all youth benefit from various policy measures and that enhanced tailored support is provided.
Ⅱ. Contents
○ Policy measures for enhancing the rights and interests of youth under the Framework Act on Youth and the current status of such measures
- Policy measures for enhancing the rights and interests of youth under Chapter IV of the Framework Act on Youth include mandatory provisions which require the State and local governments to come up with measures and policies for enhancing the rights and interests of youth.
- A youth policy implementation plan for 2022 include 148 job-related tasks, 27 related to habitation, 107 related to education, 54 related to welfare and culture, and 40 related to participation and rights.
○ Legal system of policy measures for enhancing the rights and interest of youth under the Framework Act on Youth
- Subordinate statutes or regulations related to the Framework Act on Youth include the Enforcement Decree of the Framework Act on Youth and Detailed Guidelines for Operation of the Youth Policy Coordination Committee.
○ Measures to improve legislative system in relation to policy measures for enhancing the rights and interests of youth under the Framework Act on Youth
- With regard to the establishment of a youth center (tentatively called) for overall operation of the policy measures for enhancing the rights and interests of youth, it is necessary to prepare a legal basis for the establishment of the youth center.
- The Framework Act on Youth needs to define discouraged youth workers so as to clarify the scope of youth targeted for job-seeking activities which are addressed in the policy measures for enhancing the rights and interests of youth.
- With regard to greatly expanding the forum of participation by youth, it is necessary to enact a law regarding establishment of a forum for deliberation and public discussion through youth platforms.
- With regard to the establishment of an integrated support system, it is necessary to enact a law in order to build a support system to help create an intermediate organization by region and a youth group by Si/Gun/Gu.
- It is necessary to enact a law related to the establishment of local and private collaboration on policy measures for enhancing the rights and interests of youth and the establishment of youth infrastructure.
- It is necessary to provide a legal basis for youth policy platform.
- In order to establish a system of cooperation for youth policy, it is necessary to establish a system to communicate policy measures for enhancing the rights and interests of youth and to provide a legislative basis for funds in order to ensure effective execution of such policy measures.
Ⅲ. Expected Effects
○ Lay the concrete groundwork for implementing policy measures for enhancing the rights and interests of youth under the Framework Act on Youth
○ Set standards for legislative improvement to ensure a systematic and continuous implementation of policy measures for enhancing the rights and interests of youth
○ Serve as census data for amendment to the Framework Act on Youth
