Legal Research on the Management and Provision of Legislative Information
Ⅰ. Background and Purpose
○This research aims to investigate and provide a legal basis for improvements by examining relevant data to address service demands, improvement needs, and deficiencies in the current system following the enactment of the "Act on the Management and Provision of Legal Information" on June 9, 2020.
○The study seeks to propose improvements to the legal system for the collection, management, and provision of legal information using artificial intelligence, and to promote the use of related legal information services and the development of the legal information service industry.
Ⅱ. Main Content
○In South Korea, legal services that utilize artificial intelligence for the digitization of legal work face strong regulatory barriers due to the Attorney-at-Law Act, making its revision inevitable. Additionally, the "Act on Legal Information" needs to be amended to promote the use and activation of legal information services and to establish and promote the foundation of the legal information service industry (legal tech industry).
○Proposed key amendments to the "Act on Legal Information" for AI-based legal information services include:
-First, consider changing the name from "Act on the Management and Provision of Legal Information" to "Act on the Provision and Utilization Promotion of Legal Information Services" to clarify the ultimate purpose and contribution of the law.
-Second, it is necessary to expand and clearly define the responsibilities of legal information production agencies and the scope of legal information collection, management, and provision.
-Third, it is required to establish a plan for the promotion and utilization of legal information services every three years and to create an annual implementation plan, including the promotion of related industries. To enhance the effectiveness of the law, it is required to mandate the submission of basic and implementation plans to the National Assembly.
-Fourth, it is necessary to establish the basis for the installation of the National Legal Information Center to clarify the organizational structure and execution means necessary for implementing the law.
-Fifth, the law should regulate the registration of legal information service providers to establish the foundation of the legal service industry (legal tech industry) and provide grounds for supporting related businesses.
-Sixth, the law should support not only the legal tech industry itself but also the convergence legal information service industry.
-Seventh, it is required to specify the establishment and operation of the Korea Legal Information Institute to regulate support by specialized organizations.
-Eighth, the law should specify the provision of intelligent legal information services and the establishment of a comprehensive legal information platform, including budget support for related business activities.
Ⅲ.Expected Effects
○Providing legal information services using artificial intelligence will contribute to making national comprehensive laws more user-friendly and understandable for citizens and businesses, and to establishing the related legal foundation.
○The promotion of the legal tech industry can be utilized as legislative measures and related government policy materials.
