KLRI Hosts 2nd Public and Private Law Scholars Conference on "The Use of Artificial Intelligence and Fundamental Issues in Public and Private Law"

The Korea Legislation Research Institute (KLRI), led by President Han Young-soo, held the 2nd Public and Private Law Scholars Conference on the theme of "The Use of Artificial Intelligence and Fundamental Issues in Public and Private Law" on Saturday, October 19, at 2:00 PM in the mock courtroom of the Law School at Sungkyunkwan University.
 
Co-hosted by KLRI, the Korean Civil Law Association, the Korean Public Law Association, the Sogang Law Research Institute, and the Sungkyunkwan Law Research Institute, the conference was organized to discuss key issues in public and private law arising from the transition to the digital era.
 
The conference featured four presentations and discussions. The first presentation, delivered by Kim Il-woo, Associate Research Fellow at the National Youth Policy Institute, addressed "Artificial Intelligence, Democracy, and Fundamental Rights." This was followed by a presentation by Lee Yoo-bong, Head of the AI Legislation Team at KLRI, on "Automated Administrative Actions through Artificial Intelligence."
 
In his presentation, Lee introduced the concept and types of automated administrative actions and outlined procedural requirements across the stages of adoption, development, and operation of AI-based administrative processes. He highlighted the absence of specific regulations governing the use of AI by the state in South Korea and proposed legislative measures necessary for implementing AI-based administrative systems.
The third presentation, by Professor Jeong Sin-dong of Hankuk University of Foreign Studies Law School, examined "Issues of Tort Liability in the AI Era: Focusing on Recent EU Legislative Discussions." The final presentation, delivered by Professor Lee So-eun of Yeungnam University Law School, focused on "The Use of Artificial Intelligence and Personal Data Protection."
Each topic was followed by a discussion featuring panelists such as Ra Ki-won, Associate Research Fellow at KLRI, Choi Na-jin, Legislative Officer at the National Assembly Secretariat, and Kang Joo-young, Professor at Jeju National University Law School.
 
KLRI President Han Young-soo stated, “The review and amendment of legislative systems related to the digital transition have so far been conducted on a micro-level, focusing on immediate issues. I hope this conference fosters discussions on various institutional improvement measures to rationalize and harmonize digital-related legislation.”
Meanwhile, KLRI established the AI Legislation Team in 2024 to facilitate the development, innovation, and utilization of artificial intelligence while minimizing risks and side effects. The team has been conducting comprehensive research to improve and develop legislative systems related to AI.
