Ⅰ. Background and Purpose
□ Background of this study
○ South Korea’s Interests and investment in Myanmar has become intense. Thereby, there is heightened Interest for Investment Act and law of property in Myanmar.
○ There is no law of property in Myanmar as compared to Korea. Individual and unintegrated law regulates law of property and no specific research has been dedicated to this area.
□ Purpose of this study
○ The aim of this research is to study law of property in Myanmar, and to make comparison with law of property in Korea.
Ⅱ. Main Contents
□ Current Status of Myanmar
- As of July, 2014, Officially the Republic of the Union of Myanmar, commonly shortened to Myanmar. The country is governed as a presidential republic.
○ Myanmar has “neutral” foreign policy with Five Principles of Peaceful Coexistence, namely, Mutual respect for each other's territorial integrity and sovereignty, mutual non-aggression, mutual non-interference in each other's internal affairs, equality and cooperation for mutual benefit, and peaceful coexistence.
○ Myanmar’s economy is known as developed country, and have unique characteristics on its own.
○ The country is governed as a presidential republic. The president has five-year mandate and elected by members of parliament. There are two vice presidents serving along with the 34 approved union government ministries including six ministers located in the President’s Office and attorney General.
○ Under its 2008 constitution, the legislature, called the Pyidaungsu Hluttaw, is bicameral and made up of two houses.
□ Comparative Study on Law of property in Myanmar and Korea
○ Difference in Civil Law
- There are difference in civil code classification method, civil law of court, property concept.
- There is necessity for specifying abstract Regulation relating to adoption on civil law and adoption law reform.
○ Difference in Law of property
- There are differences in nature of Study on Law of property, Regulation status on Law of property settlement, good faith acquisition, Subject of registration and its effects. types of register, registration of security Act.
Ⅱ. Expected Effects
□ The research serves as basic information for Myanmar’s law of Property.
□ The research can be helpful Korean investors and serve as useful information for relevant government branches as they research Myanmar’s law of property.
