The Korea Legislation Research Institute (President Yeong-soo Han) hosted the 3rd Korea-China Data Intelligence Legislation Forum on Thursday, June 19th, at 1:00 PM in the Diamond Hall of the Sonokam Resort in Jeju. The forum, held in collaboration with Inha University's AI Data Law Center and the Internet Law Research Institute of the East China University of Political Science and Law, focused on the theme “Legal Issues of Data Sovereignty and Data Security in the Era of AI Transformation (AX).”
This forum brought together experts from both Korea and China to engage in in-depth discussions centered on the legal and institutional challenges surrounding the rapidly emerging use and protection of data in the AI era.
The forum proceeded with keynote speeches and presentation sessions. Keynote speakers included Won-oh Kim, Director of Inha University's AI Data Law Center, and Fuping Gao, Director of the Internet Law Research Institute of the East China University of Political Science and Law. They presented on "Intellectual Property Law-related Issues and Challenges in Style Appropriation via Prompting" and "Rules for Distributing Rights of Data Holders and Judicial Application," respectively.
Session 1 was moderated by Professor Young-hwa Sohn, Dean of Inha University Law School. Experts from East China University of Political Science and Law participated as presenters, highlighting various legal issues. Associate Professor Poong-ryang Kim presented on “How Should Chinese Courts Respond to the U.S. Loomis Case?”; Special Researcher Qin Xiang analyzed two years of experience implementing China's Personal Information Protection Law; and Lecturer Ja-myo Seo presented on copyright regulation pathways for generative AI content.
The second session was chaired by Research Fellow Won-gyu Jang of the KLRI. Presenters included Professors Young-jin Jeong and Chan-mo Jeong of Inha University, and Won-jun Jeong, Head of the AI Legislation Team at the KLRI. This session discussed topics including cross-border data transfers, legal and policy implications of MyData, and legal challenges in processing training data.
In his presentation titled "Legal Challenges in Training Data Processing in the AI Era," Team Leader Won-jun Jeong emphasized, “Training data is an extremely valuable resource in the AI era.” He particularly pointed out that key challenges include determining the scope within which publicly available information can be utilized and how to harmoniously protect the legal rights of individual rights holders, such as personal information and copyright, during this process.
Yeong-soo Han, President of the KLRI, stated, “Digital transformation and the advancement of artificial intelligence technology are driving innovative changes across society. It is an urgent task to revise legislation in step with these changes and achieve international coordination.” He added, “It is meaningful that prominent researchers from both Korea and China gathered at this forum to share each country's legislative status and theoretical insights, and further explore common normative directions together.”
Meanwhile, the forum featured a signing ceremony for a Memorandum of Understanding (MOU) between the Korea Legislation Research Institute, Inha University's AI and Data Law Center, and the Internet Law Research Institute of the East China University of Political Science and Law. This agreement will establish a framework for sustained joint research in AI and data law among the three institutions.
